合した履行がなされないおそれがあると認め
られるとき、又はその者と契約を締結するこ
とが公正な取引の秩序を乱すこととなるおそ
れがあって著しく不適当であると認められる
ときは、予定価格の制限の範囲内の価格を
もって入札した他の者のうち最低価格をもっ
て入札した者を落札者とすることがある。
