(6)落札者の決定方法予決令第79条の規定に
基づいて作成された予定価格の制限の範囲内
で最低価格をもって有効な入札を行った者を
落札者とする。ただし、落札者となるべき者
の入札価格によっては、その者により当該契
約の内容に適合した履行がなされないおそれ
があると認められるとき、又はその者と契約
を締結することが公正な取引の秩序を乱すこ
ととなるおそれがあって著しく不適当である
と認められるときは、予定価格の範囲の価格
をもって入札した他の者のうち最低価格を
もって入札した者を落札者とすることがあ
る。
なお、予決令第85条に基づく調査基準価格
が設定された場合において、落札者となるべ
き者の入札価格が調査基準価格を下回るとき
は、予決令第86条の調査を行うものとする。
