(4)入札の無効本公告に示した競争参加資格
のない者の入札、総合評価のための書類に虚
偽の記載をした者の入札及び入札に関する条
件に違反した入札は無効とする。
(5)契約書の作成の要否要.
(6)落札者の決定方法本公告に示した調達案
件を履行できると支出負担行為担当官が判断
した総合評価のための書類を添付して入札書
を提出した入札者であって、予算決算及び会
計令第79条の規定に基づいて作成された予定
価格の制限の範囲内で支出負担行為担当官が
入札説明書で説明する、性能、機能、技術等
(以下「性能等」という。)のうち、最低限の
要求要件をすべて満たしている性能等を提案
した入札者の中から、支出負担行為担当官が
入札説明書で定める総合評価の方法をもって
落札者とする。ただし、落札者となるべき者
の入札価格によっては、その者により当該契
約の内容に適合した履行がなされないおそれ
があると認められるとき又はその者と契約を
締結することが公正な取引の秩序を乱すこと
となるおそれがあって著しく不適当であると
認められるときは、予定価格の制限の範囲内
の価格をもって入札した他の者のうち他の評
価の最も高い者を落札者とすることがある。

dering for
participating in the proposed tender are
those who shall:
① not come under Article 70 of the Cabi-
net Order concerning the Budget, Audit-
ing and Accounting. Furthermore, mi-
nors, Person under Conservatorship or
Person under Assistance that obtained
the consent necessary for concluding a
contract may be applicable under cases
of special reasons within the said clause.
②not come under Article 71 of the Cabi-
net Order concerning the Budget, Audit-
ing and Accounting
③ have the Grade A", "B" or "C" in terms
of qualification "Provision of services"
for participating in tenders by Ministry
of Agriculture, Forestry and Fisheries
(Single qualification for every ministry
and agency) in the fiscal year 2025,2026
and 2027.
④ meet the qualification requirements
which the Obligating Officer may specify
in accordance with Article 73 of the Cabi-
net Order
⑤Prove not to be a period of receiving
nomination stop from the contracting of-
ficer etc.
