⑸　落札者の決定方法　入札書の入札価格が予算決算及び会計令第79条の規定に基づいて作成された予定価格の制限の範囲内で最低価格をもって有効な入札を行った者を落札者とする。ただし、次に掲げる場合に該当すると認められる場合には、予定価格の制限の範囲内

の価格をもって入札した他の者のうち、最低の価格をもって入札した者を落札者とすることがある。

イ　落札者となるべき者の入札価格によっては、その者により当該契約の内容に適合した履行がされないおそれがあると認められる場合。

(イ)　本入札は、契約の内容に適合した履行がされないおそれがあると認められる場合の基準を設定している。

(ロ)　上記(イ)の基準を下回った入札があった場合には、入札を「保留」して終了し、調査のうえ、その結果を後日通知する。

(ハ)　上記(イ)の基準を下回った入札者は、事後の事情聴取等に協力すること。

ロ　その者と契約を締結することが公正な取引の秩序を乱すこととなるおそれがあって、著しく不適当と認められる場合。

⑹　Qualification for Participating in the tendering procedures : Suppliers eligible for participating in the proposed tender are those who shall ; ①not come under Article 70 of the Cabinet Order concerning the Budget, Auditing and Accounting ; Furthermore, minors, Person under Conservatorship or Person under Assistance that obtained the consent necessary for concluding a contract may be applicable under cases of special reasons within the said clause ; ②not come under Article 71 of the Cabinet Order concerning the Budget, Auditing and Accounting ; ③have Grade “A, B or C in the Manufacturing or Selling” in terms of the qualification for participating in tenders by Organizations in the Kinki area related to the Ministry of Finance (Single qualification for every ministry and agency) in the fiscal years 2022, 2023 and 2024 ; ④have not received suspension of designated contractor status, etc. from any ministry or agency (including person specially qualified by officials in charge of disbursement of the procuring entity) ; ⑤an eligible person is a person whose business condition and credit are deemed not to be a severe degradation, and who is sure to implement the contract.
