(4)入札の無効本公告に示した競争参加資格
のない者のした入札、申請書、資料又は誓約
書に虚偽の記載を行った者のした入札、求め
られる義務を履行しなかった者のした入札、
その他入札に関する条件に違反した者のした
入札は無効とする。
(5)契約書作成の要否要。
(6)落札者の決定方法経理責任者より本件に
かかる競争参加資格の確認を受けて入札書を
提出した入札者であって、実施規則第31条の
規定に基づいて作成された予定価格の制限の
範囲内で、最低価格をもって有効な入札を
行った者を落札者とする。ただし、落札者と
なるべき者の入札価格によっては、その者に
より当該契約の内容に適合した履行がなされ
ない恐れがあると認められる時、又はその者
と契約を締結することが公正な取引の秩序を
乱すこととなる恐れがあって著しく不適当で
あると認められるときは、予定価格の制限の
範囲内の価格をもって入札した他の者のうち
最低の価格をもって入札した者を落札者とす
ることがある。
(7)競争参加資格を有していない者の参加上
記2(3)に掲げる競争参加資格を有していない
者も上記3(3)により申請書、資料及び誓約書
を提出することができるが、競争に参加する
ためには、開札の時において、当該有資格者
であり、なおかつ競争参加資格の確認を受け
ていなければならない。
(8)入札制限対象企業の参加入札制限対象企
業の指定を受けた者も上記3(3)により申請書
等を提出することが出来るが、競争に参加す
るためには、開札日の前日までに特定調達契
約の入札制限等に関する規則第8条に基づく
入札制限適用除外申請書を提出し、経理責任
者の承認を受けていなければならない。
