(6)落札者の決定方法契約事務取扱細則第37
条の規定に基づいて作成された予定価格の制
限の範囲内で最低の価格をもって有効な入札
を行った入札者を落札者とする。ただし、契
約の相手方となるべき者の申込みの価格が、
申込みに係る価格によってはその者により当
該契約の内容に適合した履行がなされないお
それがあると認められるとき(契約事務取扱
細則第14条第1項第一号)、又は契約を締結
することが、公正な取引の秩序を乱すことと
なるおそれがあって、著しく不当であると認
められるとき(契約事務取扱細則第14条第1
項第二号)は、予定価格の制限の範囲内の価
格をもって申込みをした他の者のうち最低の
価格をもって申込みをした者を当該契約の相
手方とすることがある。理事長等は、落札者
が決まった場合は、直ちにその者と交渉し、
契約価額を決定する(契約事務取扱細則第16
条)。

those who shall:
①not come under Article 6 of the Regula-
tion concerning Contract for National
Center for Child Health and Develop-
ment. Furthermore, minors, Person under
Conservatorship or Person under Assis-
tance that obtained the consent necessary
for concluding a contract may be appli-
cable under cases of special reasons with-
in the said clause ;
② not come under Article 7 of the Regula-
tion concerning Contract for National
Center for Child Health and Develop-
ment:
③ have Grade A, B or C in "Manufactur-
ers of products" or "Sales of products" for
participating in tenders by Ministry of
Health, Labour and Welfare (Single qua-
lification for every ministry and agency)
in Kanto-Koshinetsu Region;
④ meet the qualification requirements
which Chief Executive Officer (CEO) may
specify in accordance with Article 5 of
the Regulation ;
